Privacy Statement

I understand that I have access to data of The Rushmore Group and I am responsible for protecting all
such data and am bound by all applicable federal and state laws and The Rushmore Group policies
I will maintain confidential all data, in any format (e.g. electronic, paper, etc.) while in my possession or
use, to the best of my abilities.
I will maintain confidential all computer information and resources to which I have access and control.
I will l take appropriate measures to safeguard and protect the information and computer resources of
The Rushmore Group that are made available to me.
I will use the information and computer resources only for authorized business of The Rushmore
Group and not disclose any information or documentation obtained from, or pertaining to, The
Rushmore Group’s computer system to any third party, except in the routine lawful conduct of The
Rushmore Group’s business.
I will ensure that if it is necessary and allowed that data will be destroyed by complying with all applicable
laws, statutes, policies, and directives.
In relation to my responsibilities regarding the proprietary rights of the authors of computer software
utilized or provided by The Rushmore Group, I recognize that:

 

The Rushmore Group pays to license the use of computer software and does not own that
software or its related documentation and, unless authorized by the software developer and The
Rushmore Group IT management, does not have the right to reproduce it. I must use software in
accordance with the license agreement, including not making unauthorized copies. I must report knowledge of any misuse of software or related documentation protected under copyright laws
to my supervisor or the Security Officer.

 

When necessary to use another agency, state or county information system, I agree to adhere to
that agency, state, and county’s policies and procedures.

 

ELECTONIC MAIL AFFIRMATION
I have read and understand The Rushmore Group Electronic Mail Policy and I agree to comply with all
terms and conditions of this policy. I understand and agree that all network and information systems
activity, conducted with the resource of The Rushmore Group resource, is the property of The Rushmore
Group. I understand that The Rushmore Group reserves the right to monitor and log all network activity,
including electronic mail, with or without notice. I have no expectation of privacy in the use of these
resources.

 

ACCEPTABLE USE AFFIRMATION
I have read and understand The Rushmore Group Information Technology and Office Equipment and Resource Acceptable Use Policy and I agree to comply with all terms and conditions. I agree to follow acceptable use guidelines and refrain from all unacceptable uses.

 

HIPAA (Health Insurance Portability & Accountability Act)
I will safeguard the privacy of protected health care information belonging to persons served by a HIPAA
covered component. I understand that protected health information is defined in federal law at 45 CFR Part
164 and included past, present, and future client health care information which is individually identifiable
and that is transmitted or maintained in any form or medium.

 

FEDERAL TAX RETURNS and RELATED DATA
I acknowledge that I have read and understand and I agree to be bound by the excerpts from the
Internal Revenue Code (IRC) 26 U.S.C. Sections 6130, 7213, 7213A, and 7431 as revised by the Internal
Revenue Code, as amended. I affirm that I will not disclose, access, or inspect any federal tax return in
any manner whatsoever, except to the extent and manner specifically required by the duties of my
position and as permitted by applicable laws, rules, or regulations and Rushmore policies and
procedures.
These protections are in addition to any existing under the state laws of The Rushmore Group customers. 

 

I understand that The Rushmore Group will take appropriate action to ensure that applicable federal and
state laws and The Rushmore Group policies governing confidentiality and security are enforced. A
violation of these requirements or misuse of The Rushmore Group property including computer
programs, equipment, and data may result in withdrawal of individual access privileges and prosecution
in accordance with any applicable state and federal laws.

accept responsibility for adhering to all applicable laws and The Rushmore Group policies and the above
listed affirmations.
